READ THESE TERMS CAREFULLY BEFORE USING THE SAFERIDE PLATFORM. BY CREATING AN ACCOUNT OR USING ANY SAFERIDE SERVICE, YOU ENTER INTO A LEGALLY BINDING AGREEMENT WITH SAFERIDE (PVT) LTD. IF YOU DO NOT AGREE TO THESE TERMS IN THEIR ENTIRETY, YOU MUST NOT ACCESS OR USE THE PLATFORM.
1. Introduction and Acceptance of Terms
These Terms and Conditions ("Terms") govern your access to and use of the SafeRide platform, including the SafeRide website, mobile applications, APIs, and all related services (collectively, the "Platform"), operated by SafeRide (Pvt) Ltd, a company incorporated under the laws of Sri Lanka.
By registering an account, initiating a booking, or otherwise accessing the Platform, you represent that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference.
These Terms apply to all Users (passengers) and Drivers (independent service providers) who access the Platform. Where terms differ between Users and Drivers, this will be stated explicitly.
2. Platform Nature — Intermediary and Marketplace Only
CRITICAL DISCLAIMER: SafeRide is exclusively a technology-enabled marketplace and intermediary platform. SafeRide does not provide transportation services. SafeRide does not own, operate, or control any vehicle used in connection with the Platform. SafeRide does not employ Drivers or any transportation personnel.
SafeRide's sole function is to provide software technology that enables Users to connect with independent Drivers who choose to offer transportation services. The transportation service contract is formed exclusively between the User and the Driver. SafeRide is not a party to that contract and assumes no obligations, representations, or liabilities arising from it.
By using the Platform, you expressly acknowledge and agree that SafeRide is acting solely as a facilitating intermediary and not as a transportation carrier, logistics provider, or employer.
3. Eligibility and Account Registration
3.1 Eligibility
You must be at least eighteen (18) years of age to create a SafeRide account.
You must have the legal capacity to enter into binding contracts under the laws of Sri Lanka.
You must not have been previously suspended or banned from the Platform.
Drivers must hold a valid Sri Lanka driving licence appropriate for their vehicle class and comply with all applicable laws governing private hire vehicles.
3.2 Account Obligations
You must provide accurate, current, and complete information during registration and maintain its accuracy at all times.
You are responsible for maintaining the confidentiality of your login credentials.
You must not share your account with or permit access by any third party.
You must notify SafeRide immediately upon discovering any unauthorised use of your account at support@saferide.lk.
SafeRide reserves the right to verify your identity at any time and to refuse or cancel registration in its sole discretion.
4. User Responsibilities
Users of the SafeRide Platform accept and agree to the following responsibilities:
4.1 Accuracy of Information
Users must provide accurate pickup and drop-off locations, contact information, and payment details.
Providing false or misleading information is grounds for immediate account termination.
Users are responsible for any additional charges, delays, or losses resulting from inaccurate information.
4.2 Personal Safety and Risk Assumption
BY USING THE SAFERIDE PLATFORM, YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT:
You are solely responsible for evaluating the suitability and safety of any Driver before entering their vehicle.
You retain full discretion to decline or cancel a ride if you feel unsafe, and SafeRide encourages you to exercise that discretion.
Transportation inherently involves risks, including physical injury and property loss. You voluntarily assume all such risks.
SafeRide does not conduct continuous monitoring of rides and cannot guarantee your safety during a journey.
You are responsible for your own conduct during the ride, including complying with the Driver's reasonable instructions regarding vehicle use.
4.3 Conduct
Users must not damage or soil Driver vehicles.
Users must not engage in abusive, threatening, or harassing conduct toward Drivers.
Users must not request Drivers to violate traffic laws or engage in illegal activities.
Users must comply with all applicable laws of Sri Lanka when using the Platform.
5. Driver Status — Independent Contractors
INDEPENDENT CONTRACTOR DECLARATION: Drivers who use the SafeRide Platform are independent contractors and NOT employees, agents, joint venture partners, franchisees, or legal representatives of SafeRide in any manner.
SafeRide does not control the manner or means by which Drivers perform transportation services. Drivers independently decide:
When and where to offer services
Which ride requests to accept or decline
The route taken, subject to User agreement
The condition, maintenance, and insurance of their vehicle
Nothing in these Terms or any other document shall be construed to create an employment relationship, agency relationship, or partnership between SafeRide and any Driver. Drivers are solely responsible for their own tax obligations, insurance, vehicle maintenance, and compliance with applicable laws and regulations.
SafeRide does not pay wages, salaries, or statutory employee benefits to Drivers. Commission or service fee deductions described in Section 8 are platform usage fees, not employment remuneration.
6. Driver Responsibilities and SafeRide Disclaimer
6.1 Driver Obligations
Drivers who access the Platform agree to:
Hold and maintain a valid driving licence, vehicle registration, and all legally required insurance, including third-party motor insurance, at all times.
Comply with all traffic laws, transport regulations, and applicable laws of Sri Lanka.
Maintain their vehicle in a roadworthy and clean condition.
Treat Users with courtesy and professionalism.
Not drive under the influence of alcohol, narcotics, or any substance that impairs driving ability.
Accurately represent their identity and vehicle information on the Platform.
Resolve disputes with Users directly and in good faith.
6.2 SafeRide's Disclaimer Regarding Drivers
IMPORTANT: SafeRide does not guarantee, warrant, or represent the quality, fitness, safety, reliability, or lawfulness of any Driver or their vehicle. SafeRide does not conduct criminal background checks, driving record reviews, or vehicle inspections beyond its discretionary onboarding process and makes no representations that such checks are comprehensive or current. ANY VERIFICATION CONDUCTED BY SAFERIDE IS FOR ITS OWN PURPOSES AND DOES NOT CONSTITUTE A GUARANTEE TO USERS. USERS ACCESS DRIVER SERVICES ENTIRELY AT THEIR OWN RISK.
7. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY THE LAWS OF THE DEMOCRATIC SOCIALIST REPUBLIC OF SRI LANKA, SAFERIDE EXPRESSLY DISCLAIMS ALL LIABILITY FOR ANY LOSS, DAMAGE, OR INJURY ARISING OUT OF OR IN CONNECTION WITH THE USE OF THE PLATFORM OR DRIVER SERVICES.
7.1 No Liability for Driver Actions
SafeRide shall not be liable for:
Any accident, road traffic collision, or vehicular incident involving a Driver and/or User.
Any personal injury, bodily harm, disability, or death sustained during or in connection with a ride.
Any loss, theft, or damage to personal property during a ride.
Any act of negligence, recklessness, or criminal conduct by a Driver.
Any delay, deviation, or failure by a Driver to complete a journey.
Any physical or verbal altercation between a Driver and User.
7.2 General Platform Limitation
SafeRide shall not be liable for:
Indirect, incidental, consequential, special, punitive, or exemplary damages of any nature.
Loss of income, revenue, profits, or business opportunities.
Loss of data or breach of personal data security beyond SafeRide's reasonable control.
Service interruptions, platform downtime, or technical errors.
Actions or omissions of third-party service providers.
7.3 Maximum Liability Cap
Notwithstanding the above, if SafeRide is found liable under any theory of law, SafeRide's maximum aggregate liability to any User or Driver shall not exceed the amount paid by that individual to SafeRide (net of Driver payments) during the three (3) months immediately preceding the claim. In any case, the maximum liability shall not exceed Sri Lankan Rupees Five Thousand (LKR 5,000).
7.4 Use at Your Own Risk
YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT YOU USE THE SAFERIDE PLATFORM AND ANY TRANSPORTATION SERVICES CONNECTED THROUGH IT ENTIRELY AT YOUR OWN RISK. SAFERIDE PROVIDES THE PLATFORM ON AN 'AS IS' AND 'AS AVAILABLE' BASIS WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
8. Payment and Commission
8.1 Fare Calculation
Fares displayed on the Platform are estimates based on factors including distance, time, route, and demand. Final fares may differ from estimates due to actual route taken, traffic conditions, or waiting time.
8.2 Platform Commission
SafeRide deducts a service commission of up to five percent (5%) (or such other percentage as may be notified from time to time) from Driver earnings as a fee for access to the Platform and associated services. This commission is disclosed to Drivers during onboarding.
8.3 Payment Processing
All digital payments are processed through authorised third-party payment gateways. SafeRide does not store full payment card details. SafeRide is not liable for payment gateway errors, delays, or unauthorised transactions caused by third-party gateway failures.
8.4 Dispute Disclaimer
SafeRide is not responsible for, and shall not be required to mediate or resolve, any payment dispute between a User and a Driver. All financial disputes regarding service quality, fare overcharges, or refund requests are to be resolved directly between the User and the Driver. SafeRide may, at its sole discretion, provide information or facilitate communication between parties but assumes no obligation to adjudicate or enforce any outcome.
8.5 Refunds
Refund requests must be submitted through the SafeRide support channel within seventy-two (72) hours of the disputed transaction. SafeRide reserves the right to approve or reject refund requests in its sole discretion.
9. Prohibited Conduct
The following conduct is strictly prohibited on the SafeRide Platform:
Registering multiple accounts or impersonating another person.
Using the Platform for any unlawful purpose, including drug transportation, human trafficking, or organised crime.
Manipulating or attempting to manipulate the Platform's fare or matching algorithms.
Posting or transmitting false, fraudulent, defamatory, or harmful content.
Attempting to reverse engineer, decompile, or interfere with the Platform's software.
Using the Platform for unsolicited commercial solicitation.
Engaging in any conduct that SafeRide determines, in its sole discretion, to be harmful to the Platform, its users, or its reputation.
10. Account Suspension and Termination
10.1 SafeRide's Right to Suspend or Terminate
SafeRide reserves the absolute right, at its sole discretion and without prior notice or liability, to:
Suspend or permanently terminate any User or Driver account.
Remove or restrict access to the Platform.
Cancel pending or active bookings.
Grounds for suspension or termination include but are not limited to: breach of these Terms, safety concerns, fraud, illegal activity, repeated complaints, or any conduct SafeRide deems incompatible with the Platform's standards.
10.2 Effect of Termination
Terminated accounts will lose access to all Platform features and historical data within a reasonable time.
Outstanding payment obligations survive termination.
Provisions of these Terms that by their nature should survive termination shall remain in force.
10.3 User Termination
Users may delete their account at any time through the Platform settings. Deletion requests are processed within thirty (30) days, subject to data retention obligations under applicable law.
11. Intellectual Property
All content, features, and functionality on the SafeRide Platform — including but not limited to the SafeRide name, logo, trademark, trade dress, software code, user interface design, data compilations, and documentation — are the exclusive property of SafeRide (Pvt) Ltd or its licensors and are protected by the Intellectual Property Act No. 36 of 2003 (Sri Lanka) and applicable international intellectual property laws.
You are granted a limited, non-exclusive, non-transferable, revocable licence to access and use the Platform solely for its intended purpose. You may not:
Copy, modify, distribute, sell, or lease any portion of the Platform.
Reverse engineer or attempt to extract the source code of our software.
Remove or alter any proprietary notices or labels on the Platform.
Use the SafeRide name or logo in any manner without prior written authorisation.
12. Dispute Resolution and Governing Law
12.1 Governing Law
These Terms and all disputes arising hereunder shall be governed by and construed in accordance with the laws of the Democratic Socialist Republic of Sri Lanka, without regard to its conflict of law principles.
12.2 Good Faith Negotiation
In the event of any dispute arising from or related to these Terms or the use of the Platform, the parties shall first attempt to resolve the matter in good faith through direct negotiation for a period of thirty (30) calendar days from the date one party notifies the other in writing of the dispute.
12.3 Arbitration
If the dispute is not resolved through negotiation, it shall be referred to and finally resolved by binding arbitration administered in accordance with the Arbitration Act No. 11 of 1995 (Sri Lanka). The seat of arbitration shall be Colombo, Sri Lanka. Proceedings shall be conducted in the English language. The arbitral award shall be final and binding on both parties.
12.4 Jurisdiction
Notwithstanding the foregoing arbitration clause, SafeRide reserves the right to seek injunctive or other equitable relief from the competent courts of Sri Lanka to prevent unauthorised use of its intellectual property or to enforce payment obligations. You irrevocably submit to the exclusive jurisdiction of the courts situated in Colombo, Sri Lanka for any matter not subject to arbitration.
12.5 Class Action Waiver
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ALL CLAIMS MUST BE BROUGHT IN THE PARTIES' INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS ACTION OR REPRESENTATIVE PROCEEDING.
13. Indemnification
You agree to indemnify, defend, and hold harmless SafeRide, its directors, officers, employees, contractors, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in connection with:
Your use of or inability to use the Platform.
Your violation of these Terms or any applicable law.
Your interaction with any Driver or User.
Any inaccurate information you provide on the Platform.
Any third-party claim arising from your conduct.
14. Force Majeure
SafeRide shall not be liable for any failure or delay in performance resulting from causes beyond its reasonable control, including but not limited to: acts of God, natural disasters, civil unrest, government actions, pandemic, epidemic, war, terrorism, power outages, internet disruptions, or third-party service provider failures.
15. Modifications to Terms
SafeRide reserves the right to amend, update, or replace these Terms at any time, in its sole discretion. Notice of material amendments will be provided through in-app notification, email, or posting of a revised version with an updated effective date.
Your continued use of the Platform following the effective date of any amendment constitutes your acceptance of the revised Terms. If you do not agree to any amendment, your sole remedy is to discontinue use of the Platform and request account deletion.
SafeRide is not required to seek your consent for non-material amendments, including clarifications, formatting changes, or corrections of typographical errors.
16. Severability
If any provision of these Terms is found to be invalid, unlawful, or unenforceable by a court or arbitral tribunal of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
17. Entire Agreement
These Terms, together with the SafeRide Privacy Policy and any Driver Agreement (where applicable), constitute the entire agreement between you and SafeRide with respect to the Platform and supersede all prior or contemporaneous communications, representations, and agreements relating to the same subject matter.
